FACTS
On the morning of March 26, 2014, plaintiff Caroline Jeannot, 29, a tech industry recruiter, was driving on U.S. Route 101, also known as Bayshore Freeway, in San Francisco, when her vehicle was rear-ended by a vehicle operated by Rebecca Jackson. Jeannot claimed to her head, neck and shoulder. Jeannot sued Jackson, alleging that Jackson was negligent in the operation of her vehicle. Jackson admitted liability., Jeannot claimed that she suffered a mild traumatic brain injury in the form of a concussion. She also claimed she suffered soft tissue to her neck and a shoulder. Jeannot subsequently presented to an emergency room for treatment and then followed up with office visits, physical therapy, and neuropsychological testing. Jeannot claimed that she suffers from headaches and somatic issues as a result of her . She alleged that as a result, she was out of work for 2.5 months and that she will miss additional time from work in the future. She also alleged that she will require additional medical treatment in the future. Thus, Jeannot sought recovery of approximately $8,000 in past medical expenses and an unspecified amount for her future medical costs. She also sought recovery of unspecified amounts for her past and future loss of wages. Defense counsel contended that social media revealed that Jeannot went to the beach and did other outdoor activities while she was off of work, which defense counsel argued was inconsistent with Jeannot’s claim of a concussion.
