FACTS
On Feb. 22, 2011, plaintiff Nartej Rana, a high school student, was stopping his vehicle a stop sign on Bradshaw Road in Elk Grove when he was rear-ended by a vehicle operated by Stanley Tang, also a high school student. Nartej claimed neck and back as a result of the accident. Nartej sued Stanley and the owner of Stanley’s vehicle, Irene Wong, Stanley’s mother. Nartej alleged that Stanley was negligent in the operation of his vehicle and that Wong was vicariously liable for her son’s actions. The defendants conceded liability., After the incident, Nartej’s mother drove him to school. However, he claimed neck and back soft-tissue and subsequently began treatment with a chiropractor two weeks later. Nartej continued treating with the chiropractor for a few months, and sought no other treatment. Nartej is now working as a nurse and is pursuing his Registered Nursing degree. However, he claimed that he has continued pain and suffering, especially while working as a nurse, and that he will never be the same. He further claimed that he will not be able to enjoy his profession as he would if he had no . Thus, plaintiff’s counsel asked the jury to award Nartej over $200,000 in damages. Defense counsel contended that despite the chiropractic treatment, Nartej never saw any physicians for his alleged or even missed a day of school. Counsel also contended that there were gaps in Nartej’s chiropractic treatment. In addition, defense counsel contended that Nartej would not be able to compare how his profession would be without pain, as he had no employment in nursing prior to the alleged . Thus, defense counsel suggested that if the jury was to award Nartej anything, it should be only $6,000.
