Plaintiffs Paul Bibo, Georgia Shields, Alex Galvez, Marc Garvey, Bryan Peter and Cedric Lauderdale, all Federal Express couriers, claimed that their employer did not pay them wages they were owed. Bibo, Shields, Galvez, Garvey and Peter initially filed a suit against Federal Express Inc. in a superior court, but it was ultimately moved to federal court, in the Northern District. Bibo, Shields and Peter were also dismissed from the case. Lauderdale then filed a similar suit against Federal Express in the Central District, and the matters were ultimately joined in the Northern District for a class action. Garvey and Lauderdale, acting individually and as plaintiff representatives of a class of 7,400 FedEx couriers, claimed that Federal Express violated California wage and hour law, primarily relating to breaks and unpaid wages.
