FACTS
During a period that spanned April 2014 and September 2018, plaintiff Marco Haro Jr., a delivery driver, and plaintiff Suheil Sitto, a delivery driver, worked for Reza Mohammadpourrad and his company, RPRT Technologies Inc. Haro and Sitto claimed that they regularly worked overtime but were not appropriately compensated. Haro and Sitto sued Mohammadpourrad, RPRT Technologies and the supplier of the branded vehicles that Haro and Sitto operated, FedEx Ground Package System Inc. Haro and Sitto alleged that the defendants’ actions constituted a violation of California’s Labor Code. Mohammadpourrad and RPRT Technologies claimed that their employees were appropriately compensated. FedEx Ground Package System claimed that it was not an employer of Haro or Sitto., Haro and Sitto sought recovery of lost wages as a result of not being paid for working overtime. They also sought recovery of attorney fees and costs.
