On Jan. 17, 2012, plaintiff Sung Loewen, 77, a retiree, began a series of appointments to have several crowns placed by Dr. Lane Ochi, a dentist. After her appointment on Feb. 5, 2014, Loewen had eight crowns placed on the right side of her mouth. However, Loewen complained that the crowns did not fit properly, causing additional dental problems. Loewen sued Ochi and another dentist, Dr. Dean Ramus, alleging dental malpractice. Ramus was dismissed from the case. The plaintiff’s expert prosthodontist opined that Loewen’s right-sided crowns were too short, causing malocclusion, which is an imperfect positioning of the teeth when the jaws are closed, and temporomandibular joint problems. Ochi claimed that Loewen had approved the implants and had no complaints until after Loewen left the dental practice on Feb. 5, 2014. Specifically, Ochi claimed that Loewen wrote a letter to him one year after the Feb. 5, 2014 appointment and complained about the crowns not fitting properly for the first time. The defense’s expert prosthodontist testified that Loewen’s right-sided crowns were in proper occlusion at the time she left the care of Ochi, which was demonstrated by molds mounted on an articulator. The expert also opined that the implants did not cause any dental problems., Loewen claimed that she suffers from malocclusion and that as a result, she suffers from TMJ dysfunction. She alleged that due to her , she cannot chew or live her life like she once did. Loewen sought recovery of $150,000 in damages. Defense counsel denied Loewen suffered any injury as a result of the placement of the crowns. The defense’s expert prosthodontist opined that Loewen did not suffer from any TMJ dysfunction.
