FACTS
On July 24, 2014, plaintiff Scanvinski Hymes was held in pretrial detention at the San Francisco County Jail. While there, deputy sheriffs handcuffed Hymes and shackled his legs. However, Hymes claimed that after the was handcuffed and shackled, the deputy sheriffs used excessive force against him. Hymes claimed he sustained to his face. Hymes sued Sergeant Milton Bliss, Sergeant Victor Sanchez, Senior Deputy Joseph Leonardini, Deputy Eugene Jones, Deputy Scott Neu, Deputy Paul Timpano and Deputy Pierre Gray. Hymes alleged that the deputy sherriffs’ actions constituted violations of his constitutional rights to be free from excessive force. Hymes claimed that after he was handcuffed and shackled, the deputy sheriffs threw him to the ground, and punched, kicked and stomped on him for over a minute. He also claimed that after they briefly stopped at a medical unit, the deputy sheriffs took him to a processing room, where they continued to beat him before taking him to a hospital. The deputy sheriffs claimed that the alleged beating did not happen and that no force was used against Hymes. They also claimed that any Hymes sustained were from Hymes flailing around., Hymes sustained a fractured nose, a fractured jaw and two lacerations near his eye. He was taken to a medical unit at the detention center and then to a hospital, where he received stitches for the facial lacerations. Hymes will not need any future medical care. Hymes sought recovery of damages for his past and future pain and suffering. Defense counsel contended that Hymes caused his own by flailing around.
