FACTS
On Feb. 15, 2011, plaintiff Jack Keegan, a project manager in his 50s, presented to Scripps Green Hospital, in San Diego with left knee pain. Keegan treated with Dr. Daniel Keefe, an orthopedist who diagnosed Keegan with a twisting injury. Keegan subsequently underwent physical therapy and received a cortisone injection in his left knee. After complaining of continued pain, Keegan underwent an MRI of left knee and was diagnosed with a torn meniscus. As a result, he underwent meniscal repair surgery on April 22, 2011. However, a follow up MRI performed on May 13, 2011, revealed that Keegan had developed spontaneous osteonecrosis in his left knee. Keegan sued Keefe, alleging that the physician was negligent for failed to diagnose and treat the osteonecrosis in a timely manner. Keegan also alleged that Keefe’s failures constituted medical malpractice. Keegan’s two MRI studies and progress notes from Keefe were entered into evidence. Scripps Health and many of its employees were also named as defendants, but they were ultimately dismissed prior to trial. Keefe’s counsel argued that Keegan had been presented with a mechanism of injury consistent with the injury diagnosed. Counsel also argued that Keefe had correctly diagnosed Keegan’s meniscus tear and that the osteoarthritis had not been visible until the second MRI., On May 13, 2011, Keegan underwent an MRI and was diagnosed with spontaneous osteonecrosis of the left knee. He was subsequently placed in a knee brace, and treated with pain and anti-inflammatory medication. He also treated with limited weight bearing. However, Keegan ultimately required a total knee replacement. Keegan claimed that despite treatment and surgery, he continues to have a restricted range of motion in his left knee. He also claimed that after he had exhausted his medical leave due to the untreated osteonecrosis and surgery, he was terminated from his employment. He alleged that as a result, he was out of work for a total of 13 months. Thus, Keegan sought recovery of past and future medical costs, and additional past and future economic damages, including lost earnings. He also sought recovery of damages for his past and future pain and suffering. He alleged that his damages totaled $986,571.
