FACTS
On May 9, 2010, plaintiff Thomas Langlois, an unemployed 34 year old, was walking his dog in an open-access bridle path behind his home in Alta Loma when he was attacked by three pit bulls that had escaped from a nearby residential property. Langlois claimed he was bitten on his left pinky finger and left leg, resulting in puncture wounds and permanent scarring. Langlois sued Jose Garcia and Natividad Valenzo, the alleged owners of the three pit bulls. Langlois claimed the three pit bulls escaped their owners’ property through a large hole in the fence. Thus, he alleged that Garcia and Valenzo were strictly liable for the attack, per the state’s dog bite statute., Langlois suffered puncture wounds to his left pinky finger and left leg as a result of dog bites. He subsequently treated at an emergency room on the date of the incident. The dog bite wounds were ultimately repaired with sutures, and Langlois was prescribed medication. Langlois claimed he is left with permanent scarring on his left pinky finger and leg. Thus, he sought recovery of $6,000 in past medical costs, and an unspecified amount of damages for his past and future pain and suffering.
