On Nov. 10, 2016, claimant Tami Langdo, 50, a state-employed caregiver for her disabled brother, was called to the bedroom window of her home in Phelan by the property manager, Sunghee Lee, who was collecting rent for the property owners, Chun Sung Heung and Hui Suk. As Langdo opened the bedroom window, Lee’s dog lunged in and latched onto Langdo’s right wrist and hand. It attempted to pull her through the window. Langdo sustained bite of her right wrist and hand. Langdo sued Lee, Heung and Suk, alleging that they were liable for the dog’s actions under the California dog bite statute. Lee acknowledged strict liability under the dog bite statute. Heung and Suk, who were related to Lee, denied having any notice of the dog’s dangerous propensities., Langdo sustained a bite mark consisting of a puncture wound in her right wrist. She went to an emergency room for treatment. She later contracted an infection, which required her to have a peripherally inserted central catheter line. Langdo also underwent physical therapy. She later underwent surgeries to repair lesions to her radial and ulnar nerves, and to remove scar tissue as a result of the dog bite. Langdo claimed that her injury will cause her to suffer a loss of earning capacity. Langdo sought recovery of medical costs, lost earnings, and damages for her pain and suffering.
