FACTS
At 2:50 p.m. on March 15, 2010, plaintiff Cheryl Davis, 27, a homemaker, was driving on the off-ramp for the southbound Interstate 5 Freeway in Anaheim, when she was struck by a vehicle operated by Benjamin Chase, who was proceeding south on Harbor Boulevard. She claimed to her neck and back from the crash. Davis sued Benjamin Chase and the owner of the vehicle, Bruce Chase. She alleged that Benjamin Chase was negligent in the operation of his vehicle and that Bruce Chase was vicariously liable for his actions. Specifically, Davis claimed that Benjamin Chase ran a red light in violation of the California Vehicle Code § 21453a. She also presented an independent witness to the accident., Davis was taken from the scene and brought to Anaheim Regional Hospital. She claimed a 2-millimeter cervical bulge at the C4-5 level and a 3-millimeter lumbar bulge at the L5-S1 level. As a result, Davis claimed she had $52,000 in medical expenses. Defense counsel contended that Davis did not suffer a serious injury in the accident. Counsel also asserted that the mechanics of the accident could not have caused her alleged disc .
