On March 20, 2013, plaintiff Eva Nguyen, a woman in her 40s, was driving on Greenford Drive when she entered the T-intersection with Stanwell Street, in San Diego, and collided with a vehicle operated by Olivia Capule, who entered the intersection from Stanwell Street. Nguyen claimed to her neck. Nguyen sued Capule, alleging the defendant was negligent in the operation of her vehicle. Plaintiff’s counsel explained that Greenford Drive was an uncontrolled through-road at the T-intersection, while Stanwell Street was governed by a stop sign. Thus, counsel contended that Nguyen did not have a stop sign at the T-intersection, while Capule did have one. Plaintiff’s counsel asserted that as a result, the collision occurred when Capule failed to oblige the stop sign before turning onto Greenford Drive. Capule conceded liability., Nguyen claimed she suffered a soft-tissue whiplash injury to her neck. She subsequently sought medical attention a few days after the accident. She then underwent two months of chiropractic treatment. Nguyen sought recovery of past medical costs, and damages for her past and future pain and suffering. Defense counsel argued that Nguyen’s injury was not caused by the subject accident.
