On Sept. 29, 2016, plaintiff’s decedent Jeff Green, 32, a methadone addict who was a patient of the Healthcare Services Inc. drug rehabilitation facility, climbed onto the roof of the Anaheim facility and committed suicide. Green had been admitted to Healthcare Services for detoxification. After seven days in detoxification, the facility transferred Green to residential treatment. On the day he was transferred, Green allegedly handed a therapist a note saying that he made it through detoxification, was proud and had a long way to go, but that if he left the clinic, he wanted the police told that he was suicidal. The facility had the therapist evaluate Green, who allegedly denied any suicidal thoughts at that time. A supervisor decided that Green would be put on 30-minute rounds. One and a half hours after the evaluation, Green climbed onto the roof of the facility and jumped to his death. Green’s mother, Barbara Green, and brothers, Garry Green and Joseph Green, sued Healthcare Services Inc., which operates as Anaheim Lighthouse; another treatment center, Windstone Addiction Centers Inc., which operates as The Lighthouse Treatment Center; a licensed mental health therapist for Healthcare Services, Mirela Casapu; and two independent contractors, Dr. Michael Bishara and Dr. Preet Joneja. Ms. Green alleged that the defendants failed to properly monitor Jeff Green and failed to consult, resulting in Jeff Green’s wrongful death. Garry Green and Joseph Green each brought claims of intentional infliction of emotional distress, negligent infliction of emotional distress and fraud. It was determined that Windstone Addiction Centers operated a different Lighthouse location, so it was dismissed from the case. In addition, Bishara and Joneja settled with the plaintiffs prior to trial, and Jeff Green’s brothers’ claims were dismissed due to the court granting defense counsel’s motion for non-suit. The matter ultimately proceeded to trial with Ms. Green’s claims against Casapu and Healthcare Services only. Plaintiff’s counsel contended that Jeff Green was negligently transferred to residential treatment even though Green continued to suffer severe withdrawal and extreme anxiety. Counsel also contended that Healthcare Services had notice that Green was at risk of suicide and that the facility knew that clients, in the past, had gained access to the roof, but that Healthcare Services failed to properly monitor Green. Plaintiff’s counsel argued that knowing that Green was at risk of suicide, Healthcare Services’ staff should have called 9-1-1 or transferred Green to a hospital. Counsel noted that no rounds were ever recorded, although several staff members did have interactions with Green. The facility’s counsel argued that Healthcare Services did everything correctly and that Green was the sole cause of his death., Jeff Green committed suicide on Sept. 29, 2016. He was 32 years old and survived by his mother and two brothers. Green’s mother sought recovery of wrongful death damages for the loss of her son.
