On March 24, 2013, the claimant, a female employee of Tarr Inc., a San Diego-based company that sells dietary supplements, informed her employer about her pregnancy. She was terminated a few days later. The company also allegedly refused to return another claimant, also a pregnant employee, to return to work after taking maternity leave. The U.S. Equal Employment Opportunity Commission first attempted to reach a pre-litigation settlement through its conciliation process. It ultimately sued Tarr and Zenith, LLC, which merged with Tarr in 2016. The EEOC alleged the defendants’ actions constituted violations of Title VII of the Civil Rights Act of 1964, as amended by the Pregnancy Discrimination Act. Defense counsel asserted that the pregnant employees were not employed by Tarr or Zenith., The EEOC sought injunctive relief and recovery of back pay for the women.
