In 2010, claimants consisting of four female workers allegedly began to be sexually harassed by a farm manager who was employed by Bornt & Sons Inc., a company that operates organic farms specializing in organic salad mix in Imperial County and is headquartered in Holtville. The workers claimed the manager leered at them, grabbed their private areas, made sexual comments, and subjected them to unwanted touching and kissing. The manager then fired or refused to rehire at least three women who allegedly refused his sexual advances and allegedly fired at least three male farmworkers for their familial association with the alleged sexually harassed victims. The U.S. Equal Employment Commission, acting on behalf of the four female workers, three male farmworkers and a class of similarly situated individuals, sued Bornt & Sons Inc. (doing business as Bornt Family Farms) and the companies that provided workers to area farms for Bornt & Sons, Barraza Farm Service, LLC and Barraza Farm Service Inc. (doing business as Barraza Farm Service and/or Barraza Farm Services). The EEOC alleged that the companies’ actions constituted sexual harassment, retaliation and wrongful termination in violation of Title VII of the Civil Rights Act of 1964. It also alleged that instead moving the harasser to a different farm, the companies failed to take corrective action when they became aware of the federal investigation into the alleged sexual harassment., The EEOC sought injunctive relief and recovery of compensatory damages on behalf of the class of workers.
