In 2013, the claimants, female Filipino workers between the ages of 17 and 23, allegedly began to be harassed by the owner of Tapioca Express, a Taiwanese-American fast food franchise, and two of its franchisees in Chula Vista and National City. The employees complained about the owner’s behavior, but they claimed that nothing was done about it. Some of the female employees quit. The U.S. Equal Employment Opportunity Commission, acting in the claimants’ behalf, sued Tapioca Express Inc. and two affiliates, Edeleen Inc. and Erivera Enterprise, LLC. The EEOC alleged that the companies’ actions constituted violations of Title VII of the Civil Rights Act of 1964. The EEOC contended that the owner intentionally used time alone with the female employees to make unwanted sexual advances. It also contended that the female employees were subjected to sexual harassment, including repeated and unwanted comments of a sexual nature and physical contact. It further contended that all three of the defendant companies failed to prevent and correct the harassing behavior, even after a written complaint was submitted, and that some of the female employees felt forced to quit due to the increased harassment., The EEOC, acting on behalf of the harassed employees, sought injunctive relief as well as monetary damages for the victims.
