Plaintiff Equal Employment Opportunity Commission alleged that a Mexican-American supervisor at Ukiah-based Dunnewood Vineyard regularly harassed a winery worker and other Mexican-born subordinates by calling them derogatory names, reprimanding them for speaking Spanish among themselves, and telling them to go back to Mexico when they complained about the illegal harassment. The vineyard is owned by Constellation Wines U.S. Inc., which is based in Victor, N.Y., and part of one of the world’s largest premium wine and alcohol beverage companies. Although the alleged supervisor was also Latino, he was born in the United States, while the workers he allegedly harassed were born in Mexico. After an investigation by an EEOC investigator and first attempting to reach a pre-litigation settlement through conciliation, the EEOC filed its lawsuit against Constellation Wines U.S. Inc. and Constellation Brands Inc., for violations of Title VII of the Civil Rights Act of 1964 for harassment based on national origin., The EEOC sought recovery of damages in the form of back pay for the lead charging party and compensatory damages for all three men.
