FACTS
In 2012, the claimant, a teenage female shift supervisor at Mexicali Chicken & Salads, in El Centro, complained about being allegedly sexually harassed by her manager. Less than one week after she made the complaint, she was fired. Plaintiff the U.S. Equal Employment Opportunity Commission, acting on behalf of the claimant, first attempted to reach a pre-litigation settlement through its conciliation process. Ultimately, the EEOC sued Mexicali Chicken & Salads, alleging retaliation and quid pro quo sexual harassment in violation of Title VII of the Civil Rights Act of 1964. Plaintiff’s counsel contended that the manager at the El Centro Mexicali Chicken & Salads sexually harassed the female employee, who rejected his advances. Counsel claimed that shortly thereafter, the female employee complained of the harassing behavior to another manager, but that within days of making the complaint and rejecting the manager’s sexual advances, the female employee was terminated. Mexicali Chicken & Salads did not respond to the complaint, and was not represented by counsel at a hearing., The claimant sought recovery of $53,096 in past lost wages and recovery of damages for her emotional pain and suffering. She also sought recovery of punitive damages.
