Beginning in April 2010, plaintiff Sandra Solorio worked as an administrative assistant and, later, as an administrative supervisor for National Retail Transportation Inc. She worked for the company until May 2012. However, she claimed during the time of her employment, she was entitled to meal and rest breaks, as well as overtime hours. She also claimed the company miscalculated her vacation pay. Solorio sued National Retail Transportation Inc., alleging violations of the Labor Code. Solorio received a directed verdict on the claim of improper deductions for vacation pay. Plaintiff’s counsel contended that Solorio was not exempt under the Fair Labor Standards Act, so National Retail Transportation failed to pay Solorio for meal and rest breaks, as well as failed to pay the appropriate rate for the overtime hours worked. Defense counsel contended that Solorio was an administratively exempt employee and that National Retail Transportation paid her a flat salary., Solorio sought recovery of damages for the alleged violations and sought recovery of waiting time penalties.
