On May 20, 2008, plaintiff Raul Villa-Estrada was hired by Priority Building Services LLC as a handyman. Villa-Estrada claimed that during the duration of his employment, his employer failed to pay certain wages and provide rest periods in violation of the California Business and Professions Code. In addition, he claimed he took a vacation on Dec. 23, 2011, and his employment was terminated on Dec. 27, 2011. Villa-Estrada sued Priority Building Services LLC, alleging wage and hour violations under the California Business and Professions Code. Villa-Estrada claimed the defendant failed to pay him overtime wages, provide rest periods, and provide itemized wage statements. He also claimed that the defendant violated Business and Professions Code § 17-200 by willfully failing to pay him his appropriate wages. Priority Building Services claimed that it followed the law and did nothing wrong. It also claimed that Villa-Estrada received, and had available to him, all rest periods and appropriate breaks. It further claimed that Villa-Estrada was paid all wages he was due and was paid for all hours worked., Villa-Estrada sought recovery of $26,040 in unpaid overtime wages and $9,264 in unpaid rest periods. He also sought recovery of $40,212 for the defendant’s wilful failure to pay his wages and $4,000 in civil penalties for the defendant’s failure to provide itemized wage statements.
