Between from June 9, 2006 and Dec. 31, 2010, plaintiffs Arabella Lemus and Malvin Ayala, tax preparers, claimed that their California employer, H&R Block Enterprises, LLC, formally known as H&R Block Enterprises Inc., failed to pay them accurate wages and reimbursements. Lemus and Ayala, acting on behalf of themselves and a class of over 18,000 seasonal, non-exempt tax professional employees, brought a class action against their employer, H&R Block. They alleged the defendant failed to pay accurate wage statements in violation of the California Labor Code § 226 and failed to pay all wages due at the time of termination of employment in violation of California Labor Code § 203. They also alleged that the defendant committed civil penalties under the Private Attorney General Act, under California Labor Code § 2698. H&R Block denied the class’ allegations., The class claimed that H&R Block failed to pay all wages and reimbursements due to them. Thus, the class sought recovery of damages for the unpaid wages and reimbursements, as well as for the penalties established by § 2699 of the Private Attorney Generals Act and/or other Labor Code sections.
