FACTS
During a period that spanned April 2016 and July 2016, plaintiff Yoo Jin Choi, a clothing designer, was employed by clothing manufacturer Catwalk to Sidewalk Inc. Choi claimed that, during that time, she was sexually harassed by the company’s president, Billy Kang. Choi also claimed that she was not paid the appropriate wages and overtime pay and that she ultimately quit in July 2016 as a result of the situation. Choi sued Kang and Catwalk to Sidewalk. Choi alleged that Kang’s actions constituted sexual harassment and battery, that she was constructively discharged, that Kang’s actions violated California’s Labor Code, and that Catwalk to Sidewalk was vicariously liable for Kang’s actions. The defendants impleaded Choi’s former supervisor, James Jang, seeking indemnification. The direct defendants’ counsel disputed Choi’s allegations and claimed that the events never happened. Counsel also claimed that Kang and Catwalk to Sidewalk were entitled to indemnification because, as Choi’s supervisor, Jang failed to report the purported issues alleged by Choi., Choi claimed that she suffered a loss of wages as a result of being paid the inappropriate amount of wages and as a result of not being paid the appropriate rate for working overtime. She also claimed that she suffered emotional distress as a result of the alleged sexual harassment and constructive discharge. However, Choi did not seek counseling to treat her alleged emotional distress. Choi sought recovery of $400,000 in total damages for her post lost earnings and for her emotional pain and suffering. She also sought recovery of punitive damages.
