In 2003, plaintiff Robert Weibezahl was hired by Raytheon Co. as a systems engineer, when he was 47. In 2009, he filed an internal complaint under Raytheon’s internal dispute resolution process, alleging that Raytheon had not promoted him to the next salary grade due to age discrimination. Raytheon investigated the claim and determined that there was no basis to believe that Weibezahl’s age played any part in his lack of promotion. Weibezahl was laid off in February of 2011 as part of a larger reduction in force. Weibezahl sued Raytheon and Justin Busse, his department manager, for age discrimination and retaliation. Busse was dismissed on summary judgment. The plaintiff alleged that Raytheon retaliated against him after he made his age complaint. The retaliation included moving him to a smaller work space; sending him for a workplace violence evaluation; and laying him off. Raytheon presented evidence that Weibezahl was moved with dozens of others because their then-current building was being sold; that Weibezahl was sent for a workplace violence evaluation because he wrote a series of disturbing manifesto-like emails alleging that Raytheon and/or others were secretly targeting unsuspecting civilians with directed energy weapons [including two weapons that were supposedly housed in apartment buildings across the street from Weibezahl’s home – plus one in the basement of the Raytheon building where Weibezahl worked; and Weibezahl was selected for layoff primarily because he could not qualify for a security clearance. Defense counsel also noted that Weibezahl was impeached at trial with testimony from a declaration and a deposition from an earlier lawsuit against Boeing and a previous employer (Swales Aerospace). Weibezahl’s trial testimony was directly contrary to several sworn statements that he had made in the prior case., Weibezahl has not found other employment. He sought $4 million in economic damages, plus punitive damages.
