On Aug. 5, 2015, plaintiff Jin Mosley, a woman in her 40s, was accused of being a bigamist by her ex-husband, Shane Mosley, a former, four-time world champion boxer, during a press interview. The Mosley’s got married in 2002 and were married for approximately nine years before filing for divorce in 2011. On Aug. 5, 2015, Mr. Mosley was at the Los Angeles County Superior Courthouse, addressing an ex-parte application that he filed with the intention of freezing the assets in the divorce judgment that was awarded to Ms. Mosley. Mr. Mosley claimed that Ms. Mosley was legally still married to her ex-husband, Sanjay Dwivedi, through the year 2006 and that Ms. Mosley was, therefore, not entitled to his assets. At the hearing, Mr. Mosley brought documents that he believed proved this claim. After exiting the courthouse, Mr. Mosley was interviewed by a videographer from the entertainment news publication/television program TMZ. During the interview, he stated, “Man, my so-called wife was married when I was married.” Later that same year, Mosley told a reporter from Fighthype.com, “So we got married in 2002, and she got married to some guy in 1995 and was still married to him when we got married.” Ms. Mosley claimed that Mr. Mosley’s statements during the two interviews in 2015 were defamatory and caused her emotional distress. Jin Mosley sued Shane Mosley, alleging that Mr. Mosley defamed her. Ms. Mosley’s counsel argued that she had divorced Dwivedi in New York State in 2002 and that she was not married to him when she soon thereafter married Mr. Mosley. Plaintiff’s counsel argued that a second divorce judgment obtained by Dwivedi in New York in 2006 was inexplicable in nature and was unnecessary because Ms. Mosley and Dwivedi’s 2002 divorce was valid. Her counsel further argued that Mr. Mosley defamed Ms. Mosley by telling two publications that she was a bigamist and that Mr. Mosley emotionally disparaged Ms. Mosley in a Twitter post that included an epithet. Defense counsel argued that Ms. Mosley was still married to Dwivedi in 2002, when Jin and Shane Mosley were married, and that Mr. Mosley’s comments to the media were truthful and, therefore, not defamatory. Counsel argued that even if Ms. Mosley was not still married to Dwivedi in 2002, Mr. Mosley did not defame his ex-wife because Mr. Mosley believed, and had documents leading him to believe, that Ms. Mosley was still married and paying spousal support to Dwivedi until 2006., Jin Mosley claimed that her ex-husband, Shane Mosley, defamed her, damaged her reputation, and caused her emotional distress and humiliation. Thus, Ms. Mosley sought recovery of an unspecified amount of compensatory damages, and punitive damages on the ground that Mr. Mosley knew that his statements were false and were, therefore, made with malice.
