FACTS
At around 3 p.m. on Feb. 25, 2010, plaintiff Hon Fong, 53, an operations analyst, was in the men’s restroom on the sixth floor of a commercial building located at 6430 Sunset Boulevard, in Hollywood. As he proceeded from the stall to the sink, he slipped and fell. Fong sustained to his back. Fong sued the owner of the building, BRCP Sunset LLC; the building manager, Transwestern Property Company West, LLC; and the provider of janitors for the subject bathroom, Metro Services Group. Fong claimed the floor of the bathroom was wet, which caused him to slip and fall. Plaintiff’s counsel contended that the restroom design was dangerous in that the paper towel dispenser was installed across the room from the sinks, causing each person who used the sinks to drip water on the tile floor in front of the restroom stall. The janitorial service, Metro Services, claimed that it made the building management, Transwestern Property, aware of the problem, but that no steps were taken to change the design, add mats to the floor, or increase maintenance in the restroom., Fong sustained to his cervical discs. After the fall, he reported feeling tingling pain and weakness in his arms. He subsequently underwent a cervical decompression and fusion at the C3-4, C4-5, and C5-6 levels on April 6, 2010. He then underwent a complicated removal of hardware at the C3-4, C4-5 and C5-6 levels; an anterior cervical discectomy and fusion at the C3-4, C4-5, C5-6, and C6-7 levels; and a posterior spinal fusion at the C2-3, C3-4, C4-5, C5-6, C6-7, C7-T1, and T1-2 levels on Feb. 16, 2012.
