FACTS
On April 15, 2010, plaintiff Edie Hudson, a retired 69 year old working in a Senior Corps position for the city of Los Angeles, was walking along South Hill Street, crossing West 2nd Street in Los Angeles, when she fell forward, striking her face on the concrete. Hudson sued the city of Los Angeles, alleging that the city failed to properly repair and/or maintain the curb, creating a dangerous condition of public property. Hudson claimed that her foot got caught in a crack in the curb, causing her to trip and fall. She claimed that although the city had done maintenance in the area on other parts of the street, it failed to repair the subject curb, allow the crack to remain and grow grass out of it. Defense counsel contended that the city had no knowledge of the crack and, therefore, could not be held liable for it., Hudson struck her face on the concrete during the fall, fracturing her two front teeth. She also claimed soft-tissue neck and back . Hudson was subsequently taken by ambulance to Olympia Medical Center in Los Angeles and then treated with a chiropractor from June 30, 2010, until Nov. 2, 2010. Plaintiff’s counsel contended that Hudson received $3,986 worth of chiropractic care and approximately $6,500 worth of emergency dental work, consisting of tooth extractions and replacements, and other dental work at the University of Southern California School of Dentistry. However, counsel noted that Hudson’s medical bills were reduced to less than $5,000, as Medicare paid for part of her bills. Hudson claimed she still has headaches and pain through the left side of her body, including the left side of her neck, her left shoulder and left hip. However, she claimed that she is functioning and continues to treat her pain with over-the-counter medicine, including Tylenol and Advil, which she has been taking since June 2010.
