FACTS
On Jan. 4, 2019, plaintiff Dennis Caruso, was operating his motorized scooter on Ferry Francois Drive, in San Francisco. When he was near the intersection with 16th Street, he was thrown from his scooter. Caruso claimed to his left shoulder. Caruso sued the owner of the roadway, the city and county of San Francisco, alleging that it failed to properly repair and/or maintain the roadway, creating a dangerous condition. Caruso claimed that his scooter struck a pothole in the roadway, causing him to be thrown from the scooter. His counsel contended that the pothole constituted a dangerous condition and that the city and county of San Francisco’s workers were negligent for failing to timely repair and/or warn of the pothole., Caruso sustained a fracture of his left clavicle and various contusions.
