FACTS
In June 2017, the plaintiff, a 13-year-old girl who participated in a boxing program at the Eastside Eddie Heredia Boxing Club, in Los Angeles, was allegedly sexually molested by Paul Gonzales, a former gold Olympic medalist in boxing who was the club’s recreation services supervisor and head boxing coach. The teenager claimed that Gonzales also sexually harassed her and that the inappropriate acts continued through November 2017. Gonzales was ultimately arrested and charged with eight felony counts, including four counts regarding lewd acts on a child. One of the teenager’s parents, acting on the teenager’s behalf, sued Gonzales; the operator of the Eastside Eddie Heredia Boxing Club, the County of Los Angeles Department of Parks and Recreation; and the operator of the department of parks and recreation, the county of Los Angeles. The parent alleged that Gonzales’ actions constituted sexual harassment and sexual assault. The parent also alleged that the county and its department of parks and recreation failed to supervise Gonzales, making them liable for Gonzales’ actions. The teenager claimed that Gonzales called and texted her using inappropriate sexual dialogue. She also claimed that Gonzales solicited and received inappropriate sexual images of her, as well as sent her inappropriate sexual images. She alleged that Gonzales ultimately sexually assaulted her. Plaintiff’s counsel asserted that the county knew, or should have known, about Gonzales’ propensity to engage in sexual misconduct with the teenager, but that the county failed to take any action to prevent the incidents from occurring. The county’s counsel asserted that the county only became aware of the alleged incidents after Gonzales was arrested., The teenager claimed that she was sexually molested. She alleged that she suffers from emotional distress as a result of the events, including the molestation and sexual harassment. The teenager sought recovery of noneconomic damages for her emotional pain and suffering.
