FACTS
On Oct.10, 2014, plaintiff Robert Harutyunyan, 42, a fire sprinkler installer for R&F Fire Protection, was working at Jordan High School, in Los Angeles. While he was testing the water line in the ceiling in one of the classrooms, Harutyunyan’s head came into contact with an overhead, energized, electrical circuit that should have never been energized while he was doing his work. As a result, Harutyunyan claimed he suffered a 277-volt electrical shock injury. Harutyunyan sued the operator of Jordan High School, the Los Angeles Unified School District; the company in charge of the electricity for the school, Taft Electric Co.; and a commercial construction company, Swinerton Builders. The Los Angeles Unified School District and Swinerton Builders were ultimately dismissed from the case. Thus, the matter continued against Taft Electric only. Harutyunyan claimed that Taft’s workers were negligent for failing to warn him that the electricity was on, when it should have been off. Taft Electric admitted that it was responsible for de-energizing the subject electrical circuit at the time of the incident, that the subject electrical circuit should not have been energized at the time of the incident, and that it should have de-energized all of the electrical circuits in the area where Harutyunyan was working at the school on the subject date. However, defense counsel for Taft Electric asserted that Harutyunyan was comparatively at fault because he was not wearing a hard hat at the time he was allegedly shocked., Harutyunyan claimed he suffered a 277-volt electrical shock, causing blurred vision, a headache, left-sided arm tingling, impaired short term memory, numbness in the tips of the digits of his left hand, numbness of his left lower extremity, and neuropathic symptoms almost immediately thereafter. He subsequently took himself to an urgent care facility later that day. Harutyunyan claimed that although he did not sustain any burn , he suffers from serious neurological, cognitive and physical as a result of the shock. He alleged that as a result, he can no longer work and will require cognitive therapy. Defense counsel for Taft Electric disputed the nature and extent of Harutyunyan’s damages. Specifically, counsel asserted that Harutyunyan was not electrically shocked, as Harutyunyan suffered no burns.
