FACTS
In June 2011, the claimant, a 62-year-old retiree, fell down a flight of stairs at a residence in Richmond, Calif., and fractured her leg when she landed on the pavement below. The retiree brought a claim against the property owner, alleging that the owner failed to properly maintain the stairway, creating a dangerous condition. The claimant alleged that the stairs lacked handrails, were unstable and were otherwise not code-compliant, constituting a dangerous condition. She further alleged that the property owner failed to make the necessary repairs to the stairs and allowed them to fall into a state of disrepair., The claimant sustained a trimalleolar fracture to her left ankle, and was taken to a hospital. The next day she underwent surgery to implant hardware via open reduction and internal fixation. However, when the skin at the surgical site did not heal, she required five rounds of surgical debridement, followed by a below-the-knee amputation of her left leg in August 2011. When the skin still did not heal, she underwent a sixth round of debridement before finally undergoing an above-the-knee amputation of her left leg in October 2011. The claimant ultimately spent 120 consecutive days either in the hospital or in a skilled nursing facility. Her paid medical costs totaled approximately $290,000. She is currently able to walk with a prosthetic leg.
