FACTS
On Aug. 22, 2016, applicant Cruz Ardon-Lopez, 43, a roofer, was working on the second floor of a structure while in the course and scope of his employment with ASA Group Construction Inc. A beam gave way, causing him to fall two stories and land 15 feet below. He sustained to his head. Ardon-Lopez filed a workers’ compensation claim against his employer, ASA Group Construction Inc., in an attempt to collect workers’ compensation benefits., Ardon-Lopez suffered a traumatic brain injury, including a subdural hematoma. He was rushed to UCLA Medical Center. Ardon-Lopez did not require surgical evacuation, so he was transferred to an acute hospital for further evaluation and treatment. He was then transferred to a neuro-rehabilitative, transitional living center for post-acute neuro-rehabilitation. However, on Sept. 20, 2018, Ardon-Lopez’s treating neuropsychologist declared Ardon-Lopez permanently and totally disabled. Ardon-Lopez’s counsel asserted that as a result of Ardon-Lopez’s participation in multi-disciplinary neurorehabilitation, Ardon-Lopez gradually acquired the necessary skills and simple strategy points to continue improving and maintain his progress. However, counsel asserted that Ardon-Lopez continues to suffer from mood disorder, depression, and chronic pain secondary to his traumatic brain injury. The respondent’s counsel asserted that as a result of Ardon-Lopez’s recovery progress, Ardon-Lopez would require less care.
