FACTS
On Oct. 4, 2010, plaintiff Ann Crain, 80, a retiree, was volunteering at “Monday Meals,” a hot meal program for the homeless at Crystal Cathedral in Garden Grove. As Crain was walking to the serving tables carrying a tray of bread, she tripped over the lip of an indoor reflecting pool, causing her to fall into the pool and fracture her right ankle. Crain sued The Crystal Cathedral and Crystal Cathedral Ministries. She alleged that the reflecting pool constituted a hazardous condition, because several other Crystal Cathedral patrons had fallen into the empty pool, but that the defendants failed to address this hazardous condition. Crystal Cathedral initially contended that it was not negligent, but ultimately admitted liability two weeks prior to trial. The matter subsequently proceeded to a trial on causation and damages., Crain suffered a bimalleolar fracture of her right ankle. She was subsequently taken from the scene of the accident by ambulance and brought to an emergency room. As a result of her injury, Crain had to be non-weight-bearing and wheelchair-bound for six weeks. She also received in-home care from a friend to assist in her daily activities, and to ensure that she did not fall again and further injure herself. Crain claimed she suffers residual pain, discomfort, and reduced mobility that prevented her from participating in activities like mission trips for her church. She also claimed $2,122.99 in Howell medical bills and $4,000 in home care costs, and sought further recovery of damages for her past and future pain and suffering. Defense counsel contended that claiming that Crain made a good recovery from her injury. Thus, counsel argued that there was no medical reason why Crain could not go on church trips and continue to participate in her pre-injury activities.
