FACTS
Between 2008 and 2010, plaintiffs’ decedent, a 35-year-old homemaker, was under the care of two physicians who prescribed her methadone and other prescription medications. The decedent had a history of alcohol and medication abuse, as well as suffered chronic depression and anxiety. She also had a history of prior suicide attempts, including an overdose on methadone one year before her death. On Feb. 21, 2010, the decedent overdosed on methadone and died. The decedent’s husband and daughter sued the two physicians. They alleged that the physicians were negligent in the monitoring of the decedent while prescribing methadone, and that their negligence constituted medical malpractice that resulted in the decedent’s wrongful death. Plaintiffs’ counsel contended that the defendant physicians failed to closely monitor the decedent while she was using methadone. Counsel also contended that the defendants failed to take proper safeguards and measures to ensure the decedent was taking the methadone as prescribed and in a reasonably safe manner consistent with the standard of care. The defendant physicians claimed that they properly monitored their patient and that the prescribed methadone dosage was not the cause of the decedent’s death. Instead, they claimed that the decedent committed suicide and that they were not liable for her death. Defense counsel pointed to the decedent’s history of suicide attempts and suicidal ideations, and asserted that the decedent intentionally ingested a large amount of methadone tabs. Thus, counsel contended that the large amount ingested explained why the post-mortem methadone blood levels were in the lethal range. As such, defense counsel asserted that the physicians did not cause their patient’s death., The decedent overdosed on Methadone and died on Feb. 21, 2010. She was 35. She is survived by a husband and daughter. Thus, the husband and daughter sought recovery of wrongful death damages for the loss of the decedent’s society and companionship.
