Plaintiff Equal Employment Opportunity Commission filed this lawsuit on behalf of Latina vineyard workers in the counties of Sonoma and Mendocino who were employed by Mid Valley Labor Services Inc., a statewide farm labor contractor. The female workers claimed that they faced sexually explicit language and propositions by their male crew supervisor. They also claimed that two women objected to the harassment and were subsequently fired. After an investigation and a failed attempt to reach a voluntary settlement through conciliation, the EEOC filed suit against Mid Valley Labor Services. It alleged that Mid Valley Labor Services was negligent for failing to address the sexual harassment complaints and for retaliating against the female workers who complained about sexual harassment. Thus, it alleged that Mid Valley Labor Services’ actions were in violation of Title VII of the Civil Rights Act of 1964. Mid Valley Labor Services claimed that the alleged harassment and retaliation did not occur, and that it acted reasonably once it was notified about the alleged harassment. It alleged that it immediately hired an investigator to determine the veracity of the female workers and that the investigation did not corroborate their allegations at all. It also alleged that even after it was found that the initial investigation did not support the female workers’ allegation of harassment, it continued investigating the allegations, but found that such investigations provided further evidence that the alleged harassment and retaliation did not occur. Accordingly, Mid Valley Labor Services claimed it vigorously defended itself in the litigation at significant costs to itself., The EEOC sought recovery in the form of unspecified damages on behalf of the Latina vineyard workers.
