Five plaintiffs, consisting of two male managers, two female managers and one female clerk, all Filipino, had lengthy work histories in their respective industry. However, they eventually complained that they were subjected to a series of racial slurs, epithets and unfair assignments and job reviews, all based on their race and ethnicity. Eventually, all of the plaintiffs were terminated from their respective positions. The plaintiffs sued their former supervisor, who was white, and the national company that formerly employed them. The plaintiffs claimed that the defendants’ actions constituted violations of the Fair Employment and Housing Act. Specifically, the plaintiffs alleged that their complaints to upper management were ignored or, in some instances, condoned by the company. Defense counsel denied the plaintiffs’ allegations in their entirety. Counsel contended that the plaintiffs were all terminated for distinct and legitimate non-discriminatory reasons concerning well-documented performance issues, and that the terminations were made by different decision-makers., The five plaintiffs sought recovery of damages based on the discrimination and retaliation against them, as well as based on their wrongful termination.
