In October 2014, plaintiff Michael Andrews, 61, a fitness director, was being evaluated by Equinox Holdings Inc., which was in the process of taking over Sports Club/LA fitness clubs, including the one located on Market Street, in downtown San Francisco, where Andrews worked. When the transition was complete, Andrews found he was no longer employed at the gym. He claimed that, instead, his position was filled by younger employees. Andrews sued Equinox Holdings Inc., alleging that the company’s actions constituted age discrimination. Andrews claimed that Equinox Holdings terminated his position, or did not rehire him, because he did not satisfy its needs. He also claimed that when he asked why Equinox Holdings wouldn’t employ him as he was walked out the door, he was told, “You have been doing this so long that I do not think we can teach you new ways.” Andrews alleged that he later learned that Equinox Holdings hired younger employees to fill his position. Defense counsel denied Andrews’ allegations, and contended that Equinox Holdings did not hire Andrews because, based on its evaluation of Andrews’ performance during the transition, Andrews would not be successful at Equinox. Counsel further contended that the decision not to hire Andrews had nothing to do with his age., Andrews worked in the fitness industry for over 30 years. He claimed he wanted to continue working in his position, but he was not allowed to do so. Andrews stated that he wanted Equinox Holdings to acknowledge that it did wrong and compensate him for its actions. Andrews sought recovery for his past loss of earnings.
