In 2011, plaintiff Rogelio Dominguez, 45, began work as a gardener for a central and southern Orange County gardening service that had 30 gardeners and five crews. Dominguez worked until 2014. During that time, he was sent to various homes to garden. He claimed that he worked 10-hour days, five to six days a week, and that he was not provided any rest breaks or overtime wages. Dominguez sued Kerry J. Snyder, KJ Snyder & Associates Inc., KJ Snyder & Associates Inc./Cooksmith Div., Snyder & Associates Pools Inc., and Snyder & Associates Landscaping Inc. Dominguez alleged that the defendants’ actions constituted a violation of the California Labor Code. Several of the defendants were voluntarily dismissed by Dominguez. Thus, the matter ultimately continued against KJ Snyder & Associates Inc./Cooksmith Div. and KJ Snyder & Associates Inc. only. Defense counsel disputed Dominguez’s allegations, arguing that Dominguez was paid for all the overtime he reported and that Dominguez did not work the amount of overtime alleged in the lawsuit., Dominguez sought recovery of back wages, plus penalties and interest.
