Plaintiff Equal Employment Opportunity Commission claimed that a 66-year-old East Indian security guard was repeatedly harassed by a coworker at Guardsmark’s San Jose location based on his age and national origin. It also claimed that the Memphis-based company violated federal law by ignoring the guard employee’s reports of harassment and by involuntarily transferring him in retaliation of those complaints. The EEOC sued Guardsmark, LLC, alleging that the company’s actions constituted violations of Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act. After an investigation by an EEOC investigator and first attempting to reach a voluntary settlement through conciliation efforts, the EEOC filed the suit.
