On Aug. 28, 2018, plaintiff Andre McClelland, an inmate at the Men’s Central Jail, in Los Angeles, was asked by deputies to leave his cell and enter another. McClelland claimed that he was asked to change cells because his friend wanted to share food with him. He claimed that the other cell was dark and had two men already in it with objects made into knives. McClelland claimed that when he entered the other cell, as ordered, he was attacked, stabbed, punched and kicked. He sustained to his torso, arms, legs and face. McClelland sued Deputies Medina, Cervantes and Juarez; Office of Supervisory Jurisdiction Enforcement Deputy Gorman; an unidentified deputy; and the deputies’ employer, Los Angeles County. McClelland alleged that the defendants’ actions constituted a violation of his civil and constitutional rights. McClelland claimed that the deputies ordered him into a cell with two armed men, one of whom was a known gang member, and that the deputies watched the fight from the control booth while laughing and cheering. He also claimed that the two men that attacked him were rewarded with food and/or privileges and that when he was returned to his cell, the deputies threatened him if he told anyone about the events., McClelland sustained lacerations to his torso, arms, legs and face. He sought recovery of damages for his past and future pain and suffering.
