Beginning in February 2009, plaintiff Mirna Santos Monroy worked as a janitor for LNS Janitorial Service LLC and Alfonso Arellano, who would enter into contracts with restaurants and various facilities to employ their janitors to take on clean-up efforts at the locations. Santos Monroy claimed that since she began working for LNS Janitorial Service and Arellano, she was paid a fixed rate for the hours she worked, despite working various hours, seven days a week. Santos Monroy sued LNS Janitorial Service LLC and Alfonso Arellano, individually and doing business as Clean View Janitorial Service. Santos Monroy alleged that she had not been paid the correct wages for the amount of time she worked, had not been given proper meal and rest breaks, and had not been provided with accurate itemized wage statements. Thus, she claimed that she was owed waiting time penalties, among other claims. Neither LNS Janitorial Service nor Arellano answered the complaint., Santos Monroy sought recovery of unpaid wages and recovery of damages for other alleged violations.
