In 2010, plaintiffs Silvano Velazco and Araceli Garcia worked as janitors for Nazario Zapata. They claimed they were paid a set amount in cash up until they stopped working in 2014. However, Velazco and Garcia claimed that they amount they were paid fell below the minimum wage. Velazco and Garcia sued Nazario Zapata, as well as Alfonso Zapata, Rosa Zapata, Zapata Janitorial Building Services Inc., Antonio Rodriguez, and Frys Electronics Inc. Alfonso Zapata, Rodriguez, and Zapata Janitorial Building Services all settled out of the case. Frys Electronics was also let out of the case. Thus, the matter only continued against Nazario Zapata and Rosa Zapata. Plaintiffs’ counsel contended that Velazco and Garcia were not paid the proper wages, as well as any overtime wages, in violation of the California Labor Code. Defense counsel contended that the amount paid in cash to both Velazco and Garcia met the minimum-wage requirements., Velazco and Garcia sought recovery of liquidated damages for their respective unpaid wages.
