On Sep. 23, 2013, plaintiff Rosemary Summers, 16, committed suicide while incarcerated at San Diego County Juvenile Hall, in Birdland, a suburb of San Diego. Between April 2012 and September 2013, Rosemary had spent six months in juvenile detention for such offenses as public intoxication and failing to obey the commands of a peace officer. On the night before Rosemary committed suicide, she put in a request to meet with a clinician, but the referral was allegedly not processed until three days later. Rosemary was ultimately found dead from a self-inflicted hanging in her room at the juvenile facility. Rosemary’s mother, Cheyenne Summers, acting individually and as the personal representative of her daughter’s estate, and Rosemary’s father, Arthur Summers, sued the operator of the juvenile Hall, the county of San Diego. Several county employees were later added as defendants, including Michael Adkins, Debbie Flores, Gallard Jackson, Mack Jenkins, Yvette Klepin, Tyra Myles, Joann Sanchez, and Craig Stover. The decedent’s parents alleged the defendants failed monitor their daughter, resulting in her wrongful death. Plaintiffs’ counsel asserted that the staff at the county’s juvenile hall failed to appropriately monitor Rosemary, who struggled with depression and had previously threatened suicide several times while incarcerated. Counsel also asserted that the delay in processing Rosemary’s request for a clinician resulted in her wrongful death. The county denied any negligence and contended that Rosemary’s suicide was the first such death in the juvenile facility in 32 years., Rosemary asphyxiated due to a self-inflicted hanging. She died on Sep. 23, 2013. She was 16 years old. Rosemary’s parents sought recovery of wrongful death damages due to their emotional distress and loss of their daughter’s love, companionship, comfort, society, and support.
