FACTS
On Jan. 31, 2019, applicant Julian Chavez, 43, a laborer, was working in the course and scope of his employment in Thousand Oaks when he fell off a scaffold and landed on the ground 8 feet below. Chavez sustained to his head. Chavez filed a workers’ compensation claim against his employer, Sunset Construction Co. Inc., which was insured by State Compensation Insurance Fund. He brought a claim against the respondent in an attempt to collect workers’ compensation benefits., Chavez was transported by paramedics to Los Robles Hospital & Medical Center, in Thousand Oaks. It was determined that he had sustained a mild traumatic brain injury. Chavez claimed that as a result of his head injury, he suffers from post-concussive syndrome, post-traumatic vision disorder, vestibular dysfunction, tinnitus and post-traumatic headaches. He also claimed he suffers from insomnia and depression. Chavez was admitted to the hospital for observation and he remained there for approximately four days. He was eventually discharged home without any formal acute rehabilitation. However, it was recommended that Chavez follow-up with various sub-specialties. He eventually underwent neurorehabilitation at the Centre for Neuro Skills, in Tarzana, as well as consulted with various specialists in the field of brain injury rehabilitation. Chavez continues to complain of chronic headaches, tinnitus, dizziness, fatigue, and memory problems. His treating medical providers opined that Chavez would benefit from ongoing supported living services and multidisciplinary medical treatment to address his ongoing symptoms for the rest of his life. The respondent’s counsel accepted Chavez’s alleged , but disputed the nature and extent of the medical care that Chavez would require.
