FACTS
On May 5, 2015, applicant Armando Gaeta, 45, a construction worker employed by Casper Co., worked at a project in Spring Valley. While in the course and scope of his employment, Gaeta plummeted 15 feet from a ladder and struck an 8-foot-tall steel storage container before landing on the concrete ground. Gaeta sustained to his head. Gaeta filed a workers’ compensation claim against Casper, which was insured by Zurich North America. He sought workers’ compensation benefits., Gaeta sustained a skull fracture and a severe traumatic brain injury with bleeding. He lost conscious when he struck the ground and did not regain consciousness until he was in transit to Scripps Mercy Hospital, San Diego. Gaeta underwent a craniotomy to remove part of the skull in order to allow the brain swelling to subside. After undergoing post-acute rehabilitation at the hospital, Gaeta was placed in a neurorehabilitation facility in San Diego. His stay at the San Diego center was shortened, and Gaeta was transferred to another neurorehabilitation facility in Encino. He was then moved to other neurorehabilitation facilities in Pomona, and then San Dimas. He also was enrolled in learning services at the facilities. Gaeta suffers from a seizure disorder as a result of his and has to be on medication. He also requires supervision for his safety. Gaeta’s daughter was designated as his guardian ad litem, and she has taken over as her father’s primary caregiver. As a result, Gaeta now lives with his daughter. The respondent’s counsel asserted that Gaeta made a good recovery.
