On Nov. 13, 2016, plaintiffs’ decedent David Craigg, 36, a sprinkler-fitter, and plaintiffs’ decedent Danny Craigg, 34, David Craigg’s brother, were motorcycling on Woodward Avenue, a straight, rural road. The road had previously been closed for improvements, including the addition of a raised cement roundabout at the intersection with Al Fonseca Lane. The Craiggs did not see the raised roundabout in time to stop. As a result, both motorcycles crashed into the roundabout. The Craiggs suffered fatal . David Craigg’s widow, Julie Anne Craigg, and their five minor children, Terrianne Craigg, Abigail Anne Craigg, Danny Craigg, Anthony Craigg and Darren Craigg, sued the developers of the road-improvement project, Woodside 05N LP and WDS GP Inc.; the engineering company that designed the roundabout, Northstar Engineering Group Inc.; the construction company that built the roundabout, A. Teichert & Son Inc.; and the owner and maintainer of the roadway, the city of Manteca. In a separate filing, Danny Craigg’s wife, Tammara Craigg, acting individually and on behalf their two minor daughters, Hailey Craigg and Mackenzie Craigg, and Danny Craigg’s estate sued Woodside 05N LP, WDS GP, Northstar Engineering Group, A. Teichert & Son, and the city of Manteca. The matters were consolidated. The Craigg families alleged that the new roundabout constituted a dangerous condition of public property and that the defendants were negligent for opening the roadway before it was safe to do so and for failing to warn of the hazardous condition. Woodside, WDS and the city cross-claimed against Northstar Engineering and A. Teichert & Son, seeking indemnification. It was ultimately determined that the city was indemnified by Woodside. A. Teichert & Son impleaded the company that made signs for the project, Chrisp Co., which was later made a direct defendant. Plaintiffs’ counsel contended that the defendants were negligent for opening the road to the public before the roundabout was completed and before the warning signs and speed reduction signs were installed. The non-municipal defendants attributed fault to each other. Their counsel also asserted that the motorcyclists were negligent, contending that they were speeding and that the Manteca police report supported the contention of high speed. Defense counsel further contended that the motorcyclists had been drinking alcoholic beverages before the collision., David Craigg and Danny Craigg both died at the scene of the accident. David Craigg, 36, was survived by his wife, Julie Craigg, 35, and their children, Danny Craigg 10, Anthony Craigg, 12, Darren Craigg, Abigail Craigg, 12, and Terrianne Craigg. Danny Craigg, 34, was survived by his wife, Tammara Craigg, and their two daughters, Hailey Craigg, 6, and Mackenzie Craigg, 10. The families sought recovery of wrongful death damages.
