FACTS
On March 16, 2016, plaintiffs’ decedent Christian Medina, 23, was standing on a sidewalk near the intersection of East 64th Street and Holmes Avenue, in the Florence-Graham section of Los Angeles, when he was approached by Los Angeles Police Department deputies in a patrol car. The deputies were responding to a 9-1-1 call about a robbery. The deputies confronted Medina, as he was allegedly wearing similar clothing to those worn by the male robber. During the confrontation, Medina was shot multiple times by the deputies, and he died at the scene. Medina’s parents, Consuelo Barajas and Hector Medina, acting individually and as their son’s successors in interest, sued Los Angeles County and the County of Los Angeles Sheriff’s Department. The lawsuit alleged that the deputies used excessive force in violation of Christian Medina’s civil rights and that the county and sheriff’s department were liable for the deputies’ actions. Plaintiffs’ counsel contended that Medina was unarmed and found to only have a cigarette package in his hand. Counsel asserted that the deputies used excessive force in shooting Medina 18 times. Defense counsel contended that, during the confrontation, Medina took a shooter’s stance and pointed a shiny object at them. Counsel asserted that the deputies did not know the shiny object was not a weapon, so they feared for their lives when Medina turned toward them with the object. Counsel contended that the deputies acted appropriately., Medina was shot 18 times and pronounced dead at the scene. He was 23 years old at the time of his death on March 16, 2016. He was survived by his parents. Medina’s parents sought recovery of wrongful death damages for the loss of their son.
