FACTS
In 2010, the plaintiff, a 14-year-old student, was sexually assaulted for the first time by Steven Andrews, 40, a teacher of Lorbeer Middle School, in Diamond Bar. The student was then sexually abused and sexually assaulted multiple times by Andrews over the course of the 2010/2011 school year. Andrews was ultimately convicted of 17 felonies related to his abuse of the minor student. The 14-year-old girl, through her guardian, sued Andrews; the principal of Lorbeer Middle School, Krystana Walks-Harper; and the employer of Andrews and Walks-Harper, the Pomona Unified School District. Plaintiff’s counsel argued that the school district’s employees failed to supervise Andrews and the student. Counsel contended that, as far back as 2001, teachers at Lorbeer Middle School complained to administrative staff that Andrews was “too playful” with students and “spent a lot of alone time” with female students, but that nothing was done about it. Counsel also contended that Walks-Harper suspected that something inappropriate was going on when Andrews and the 14-year-old student where missing from school the same day and then showed up at school together later that day. However, plaintiff’s counsel contended that the incident was not reported to law enforcement or to child welfare authorities, and that although Walks-Harper spoke to the district superintendent about the behavior at least twice, the district never launched an investigation. Counsel for the school district and Walks-Harper argued that the district and its employees were not negligent in the supervision of Andrews or the plaintiff. Counsel contended that the school district performs background checks before hiring employees and that no questionable behavior turned up before hiring Andrews. Counsel also contended that the alleged sexual abuse occurred off-campus and that the school district considered Andrews’ actions to be unacceptable. Thus, counsel contended that once the district learned about the situation, it immediately terminated Andrews., The 14-year-old student, who was 19 years old at the time of trial, claimed that she suffers emotional distress as a result of incidents. Thus, she sought recovery of damages for her past and future emotional distress, as well as sought recovery for her future medical expenses due to her psychological care. Defense counsel contested the nature and extent of the plaintiff’s alleged damages.
