In January 2009, plaintiff Brandi Cochran, a model in her 30s, was terminated from the game show “The Price is Right,” where she worked for almost eight years. She claimed that she was terminated when she attempted to return from her pregnancy leave. Cochran sued her employers, CBS Corp., CBS Television Network, FremantleMedia Ltd., FremantleMedia North America, The Price Is Right Productions Inc. and RTL Group. She alleged that the defendants’ actions constituted pregnancy and disability discrimination, resulting in her wrongful termination. Prior to trial, CBS Corp., CBS Television Network, FremantleMedia Ltd. and RTL Group were dismissed. Thus, the matter proceeded to trial only against FremantleMedia North America and The Price Is Right Productions Inc. Cochran claimed that her employment was terminated because of an alleged stigma related to pregnant models. She alleged that prior to her termination, she was treated differently and that despite being able to perform her job duties, FremantleMedia North America and The Price Is Right Productions manufactured reasons to justify not rehiring her. FremantleMedia North America and The Price Is Right Productions denied all of Cochran’s allegations and contended that she was not discriminated against., Cochran claimed she suffered emotional distress as a result of the alleged discrimination and wrongful termination. Thus, she sought recovery of past and future compensatory damages. Cochran also claimed that FremantleMedia North America and The Price Is Right Productions acted with malice and/or reckless indifference to her rights. Thus, she sought recovery of punitive damages. Defense counsel denied Cochran suffered any emotional distress.
