On June 29, 2017, the plaintiff, a 15-year-old boy, was booked by the San Francisco Juvenile Probation Department into the county’s locked juvenile facility, overriding a risk assessment indicating that he should be released. The teenager was previously arrested and charged with a nonviolent property offense. He was then booked by the probation department. The next day, on June 30, 2017, a judge of the San Francisco County Superior Court ordered the teenager’s release. However, he was not released, and the juvenile probation department held the teenager in custody until July 3, 2017, when the judge again ordered him to be released. The teenager’s mother, Tureko Straughter, acting individually and as her son’s guardian, sued the City and County of San Francisco; the San Francisco Juvenile Probation Department; the Chief of the San Francisco Juvenile Probation Department, Allen Nance; and Deputy Probation Officers Samuel Nwigwe, Toni Powell, Roger Gainey and Karen Sanchez. Straughter alleged that the defendants violated her son’s civil rights. Plaintiffs’ counsel contended that even though the officers of the juvenile probation department received the court order to release Straughter’s son, they failed to do so before being ordered to release the teenager a second time on July 3, 2017., The teenager claimed that he suffered emotional distress as a result of being held at the facility. The teenager sought recovery for his emotional pain and suffering.
