FACTS
On Nov. 16, 2017, plaintiff Maria Solis Munoz and her two sons, plaintiff’s decedents Jose Hernandez, 7, and Marco Hernandez, 9, were on their way home from their school near the border of Boyle Heights and East Los Angeles. As they were walking on a sidewalk near the intersection of Indiana Street and Whittier Boulevard, Deputy Sheriff Carrie Robles drove through the intersection with his the emergency lights on his sport utility patrol vehicle and collided with another vehicle. Robles’ vehicle then swerved onto the sidewalk, where it struck Munoz and her sons. Munoz sustained to her pelvis, while her sons suffered fatal . Munoz, acting individually and as her sons’ successor in interest, sued Robles; Robles’ training officer who was a passenger in Robles’ vehicle, Deputy Sheriff Vincent Moran; and Robles’ and Moran’s employers, the county of Los Angeles and the Los Angeles County Sheriff’s Department. The lawsuit alleged that Robles was negligent in the operation of his SUV and that Moran was negligent in the training of Robles. The lawsuit also alleged that the county was vicariously liable for both Robles’ and Moran’s actions while in the course and scope of their employment. Plaintiffs’ counsel contended that traffic investigators found Robles caused the accident by going through the red light without both lights and a siren to alert pedestrians and other vehicles to yield the way., Munoz suffered a crush injury to her pelvis. She was taken to a hospital along with her 9-year-old son, Marco, who had also suffered traumatic . Marco died at the hospital. Munoz’s 7-year-old son, Jose, also suffered traumatic . He died at the scene of the accident. Munoz sought recovery of medical costs and damages for her past and future pain and suffering. She also sought recovery of wrongful death damages for the loss of her two minor sons, as well as emotional-distress damages as a result of witnessing the deaths of her children.
