FACTS
On March 2, 2017, plaintiff Ronnie Solis, 19, an airline’s baggage handler, was motorcycling on Interstate 105, in Los Angeles. She was involved in a sideswipe collision with an oncoming vehicle that was being driven by Roshan Desai, who had crossed the roadway’s centerline. Solis fell onto the roadway, and she suffered of a wrist. Solis sued Desai and Desai’s employer, Gorman Health Group, LLC. The lawsuit alleged that Desai was negligent in the operation of his vehicle. The lawsuit further alleged that Gorman Health Group was liable because the accident occurred during Desai’s performance of his job’s duties. Defense counsel conceded liability. The matter proceeded to damages., Solis suffered displaced fractures of her right, dominant arm’s wrist. The fractures involved the scaphoid and the ulna styloid process. Solis was transported to a hospital, where her fractures were addressed via application of Kirschner wires, which are commonly termed "percutaneous pins." She later required arthroscopic surgery and fusion of the wrist. Solis claimed that she suffers residual diminution of her right wrist’s range of motion. She sought recovery of damages for past and future pain and suffering. Defense counsel reported that Solis withdrew claims regarding complex regional pain syndrome, post-traumatic stress disorder, an injury of the brain and an inability to work.
